Grape Vine Fine Wines and Accessories, Inc. (The Grape Vine, The GrapeVine)
Through placing an order with the Grape Vine, it is assumed that YOU HAVE READ AND FULLY UNDERSTOOD ALL TERMS, AND CONDITIONS OF SALE DESCRIBED HEREIN.

PLEASE NOTE THAT DAMAGE TO PRODUCT THAT IS CAUSED BY THE WEATHER WILL NOT BE REFUNDED OR REPLACED BY THE GRAPE VINE. PLEASE BE AWARE OF THIS PROVISION PRIOR TO PLACING AN ORDER.
1. The Grape Vine reserves the right to accept or reject orders in its sole and absolute discretion.
2. All prices are net on 750 ml bottles unless otherwise indicated, and all orders are subject to stock on hand.
3. Prices are subject to change without notice. The Grape Vine reserves the right to correct pricing errors.
4. The Grape Vine does not sell wine or other alcoholic beverages to persons under the age of twenty-one. By placing an order, you are warranting that you are at least twenty-one years of age. The Grape Vine will vigorously pursue all rights and remedies against any person who misrepresents their age in order to purchase alcoholic beverages from The Grape Vine.
5. The Grape Vine’s shippers require age verification at the time of delivery and proof of identification may be required. If product is returned to The Grape Vine for failure to provide age verification, The Grape Vine will hold you liable for shipping charges and any other incidental expenses incurred.
6. You are responsible for the shipment of your purchase. By placing an order with The Grape Vine, you are expressly authorizing The Grape Vine to ship product to you with a common carrier of its discretion. The Grape Vine reserves the right to refuse shipment if it deems, in its sole and absolute discretion, shipment unreasonable or unsafe. The Grape Vine will pay shipping costs if product is returned by error of The Grape Vine, but is not responsible for shipping costs for any other reason.
7. The Grape Vine will ship your order via air or ground (as selected by you) in a commercially reasonable manner as soon as commercially practicable. In-stock items will be shipped within 24-48 hours of being placed. If your order includes an item that is temporarily out-of-stock, but due to arrive within a few days, it will be delayed in an effort to ship the complete order. In that event of delay we will attempt to notify you via e-mail, and or telephone.
8. Pre-orders and futures will be shipped upon arrival.
9. Buyer accepts all risks and liability for wines that are older than 5 years from currently released vintage. The Grape Vine follows the industry standard and does not accept any returns or provide store credits for said wines.
10. The Grape Vine automatically includes insurance coverage in every purchase. The charge is $.50 per $100 and covers breakage or loss. Note that weather damage is not covered by the policy. 11. An additional surcharge may be applied to the shipment of sparkling wines due to the weight of the product. Customer will incur an additional charge of $3.50 for each shipping box that is necessary to transport entire order. This fee is a condition set by FedEx and UPS for the Adult Signature requirement. Customer will also incur an additional shipping and handling charge of $1.25 per bottle to cover the cost of the insulated shipping containers. 12. The Grape Vine will ship internationally with Federal Express International and shipping rates are based on size, weight, and value of the shipment. Please call our Shipping Department at 949-380-9463 between the hours of 11 A.M. - 6 P.M. U.S. Pacific Standard time Tuesday through Sunday for current international shipping rates. Please be aware that international shipments will bear duties and taxes which are calculated only upon arrival at their destination. International Customs Fees and Duties will be applied to our regular shipping fees, and will be billed to you at a later date.
13. The Grape Vine sells its wine in the state of California and title passes to the purchaser in California. The Grape Vine expressly disclaims any liability for your failure to comply with federal, state, or local laws, statutes, or ordinances regarding the importation of wine into your domicile or place of business. By placing an order with The Grape Vine, you expressly warrant that you are complying with applicable law and will hold The Grape Vine harmless from all actions that may arise from shipping to you.
14. All orders shipped outside of the state of California are not subject to California sales tax. Sales made at The Grape Vine’s retail store(s) are subject to California sales tax.
15. THE GRAPE VINE EXPRESSLY DISCLAIMS ALL LIABILITY FOR DAMAGE TO PRODUCT CAUSED BY WEATHER DURING TRANSPORT. PLEASE SELECT SHIPPING OPTIONS PRUDENTLY.
16. The Grape Vine will hold wines for future shipment only if your area is experiencing extreme weather conditions. It will hold wines under other circumstances at its discretion. A fee is required and a restocking or cancellation fee (15% or $30.00, at our discretion) will apply to changes to "hold" or "pre-arrival" orders. If "hold" orders are not shipped within six months of purchase, we may assess additional storage fees in any amount or sell the items solely at our discretion, and our liability in such cases is limited to the original transaction price.
17. Orders to pick up from The Grape Vine retail store must be picked up within four weeks of placement. At that point, The Grape Vine may assess a restocking or cancellation fee and may resell the product at our discretion.

19. Your failure to provide accurate credit card information, including the proper billing address, may result in the inability to fill your order. The Grape Vine disclaims any liability for failure to ship product that results from your providing of incomplete or inaccurate information.
20. ACCEPTANCE; RETURNS: Buyer shall inspect products promptly upon their receipt. Unless Buyer notifies The Grape Vine in writing within seven (7) days after the receipt of products, Buyer shall be deemed to have accepted the products. Buyer may not revoke its acceptance of Products and shall be barred from any remedy. The Grape Vine will not accept returns on wine except in situations where the product is corked or flawed. We are also unable to accept returns on wine that has been damaged due to adverse weather conditions during shipment. No products delivered and accepted under this Agreement are subject to returns except upon written approval of The Grape Vine.
